Obchodní podmínky

Obchodní podmínky jsou platné pro internetový obchod www.chodicizvirata.cz, www.chodicizviratka.cz a upravují práva a povinnosti prodávajícího (provozovatel) a kupujícího (zákazník).

Objednávka a platba zboží

Minimální hodnota objednávky není stanovena.

Po odeslání objednávky Vám bude na e-mail uvedený při registraci zasláno potvrzení. V případě, že v něm najdete nesrovnalosti, nebo pokud se stane, že potvrzení neobdržíte do 12 hodin od odeslání objednávky, neprodleně nás prosím kontaktujte.

Objednáním zbožím potvrzujete, že jste se seznámili s obchodními podmínkami a že s nimi souhlasíte. Veškeré objednávky potvrzené přes webové rozhraní jsou považovány za závazné. Své objednávky můžete stornovat maximálně do 24 hodin prostřednictvím e-mailu info@chodicizvirata.cz

Platit můžete také v hotovosti při převzetí na provozovně v Praze či některou z platebních možností uvedených na www.chodicizvirata.cz, www.chodicizviratka.cz. 

Registrace

V našem obchodě můžete nakupovat jako registrovaní zákazníci.

Výhoda nákupu s registrací spočívá v tom, že máte vytvořen svůj uživatelský účet, který obsahuje všechny údaje související s objednáním a platbou zboží (adresa, kontaktní údaje apod.). Při každém nákupu se tyto údaje automaticky zobrazí a Vy je nemusíte vždy znovu vypisovat.

Dodání zboží

Zboží Vám bude zasláno přepravní firmou. Vyzvednout si je můžete také osobně na adrese provozovny.

Způsob přepravy zvolíte při vyplňování objednávkového formuláře.

Ke každé zásilce je přiložena faktura, kterou si uschovejte pro případ vrácení či reklamace zboží. Zboží odesíláme dle aktuální dostupnosti, o které Vás budeme informovat emailem. O odeslání zboží budete opět informováni e-mailem.

 

Převzetí zásilky

Nepřevzetí zásilky

Pokud Vám zásilka dojde poškozená – otevřená, poškozený obal, promáčení apod., nepřebírejte ji. Vyžádejte si od dopravce sepsání škodního protokolu o shledané závadě. Zásilka bude doručena zpět odesílateli. Skutečnost o shledané závadě a sepsání protokolu nám prosím oznamte, abychom se mohli domluvit na dalším postupu. Na pozdější reklamaci závady vzniklé poškozením zboží při přepravě zjištěné až mimo přítomnost poštovního doručovatele, není možno brát ohled.

Reklamace poškození zboží během přepravy

V případě poškození zboží během přepravy je nutné uplatnit reklamaci u dodavatele pokud možno ihned. V případě PPL je lhůta, během které můžete nahlásit případné závady, třídenní. Je nutné zachovat zásilku v původním stavu včetně obalů a výplní. Zároveň nás prosím kontaktujte e-mailem, abychom mohli přispět k rychlému vyřešení situace.

Kontrola dodaného zboží

Po převzetí zásilky zkontrolujte, zda dodané zboží odpovídá Vaší objednávce. V případě, že balík přijde nekompletní či chybně vyexpedovaný, neprodleně nás informujte e-mailem. Převzetím zboží přechází na kupujícího nebezpečí škody na zboží. V případě, že kupující zaplatil kupní cenu, přechází na něj vlastnické právo ke zboží jeho převzetím.

Osobní odběr v kamenném obchodě

Zboží si můžete také vyzvednou osobně na adrese provozovny. Zboží zde bude k vyzvednutí po zaslání potvrzujícího e-mailu, že je Vaše objednávka připravena. Zboží zde pro Vás uschováme po dobu jednoho týdne od data zaslání informačního e-mailu, po dohodě je možné dobu úschovy upravit Vašim potřebám.

Reklamace a případné vrácení zboží

Záruka se nevztahuje na vady vzniklé nevhodným užíváním věci, opotřebení věci způsobené jejím obvyklým užíváním, ani na vady, pro které byla sjednána nižší cena.

Reklamace se řídí občanským zákoníkem.

Při reklamaci je nutné dodržet tento postup: 

  1. O reklamaci nás informujte telefonicky nebo prostřednictvím e-mailu nejpozději do 24 hodin.
  2. Uveďte jméno a příjmení, adresu, číslo Vašeho účtu (za účel převodu peněz v případě uznání reklamace) a důvod reklamace
  3. Se zbožím zašlete kopii faktury.
  4. Zboží zasílejte jako cenný balík. Zásilky posílané na dobírku nebudou přijaty.

Pokud bude reklamace oprávněná, bude Vám zboží vyměněno kus za kus, či vrácena peněžní částka. Do vrácené částky se nezapočítává cena poštovného a balného. Peníze budou poukázány na Váš účet. V případě neoprávněné reklamace je Vám zboží zasláno zpět na náklady kupujícího.

V případě nevyhovujícího zboží je po dohodě možná výměna.

Vrácení zboží

Zboží je možné bez udání důvodu vrátit nepoužité, nepoškozené, kompletní a v původním obalu do 14 dnů od převzetí zásilky. Zboží musí být zcela schopné dalšího prodeje. O vrácení zboží nás informujte telefonicky nebo prostřednictvím e-mailu. Se zbožím musí být vrácena faktura, bez ní nebude převzetí zboží a následné vrácení peněz vyřízeno. Po kontrole stavu a kompletnosti zboží Vám budou peníze vráceny na účet. Zboží zasílejte jako cenný balík. Zásilky posílané na dobírku nebudou přijaty. Náklady na dopravné se nevrací.

Zrušení objednávky ze strany provozovatele obchodu

Provozovatel si vyhrazuje právo zrušit objednávku nebo její část v těchto případech: 

  • Zboží se již nevyrábí nebo nedodává, není skladem nebo se změnila výrazným způsobem cena zboží.
  • Neproběhla platba ze strany nakupujícího.
  • O zrušení či změně v objednávce z výše uvedených důvodů budete informováni a následně s Vámi dohodneme další postup.

Ochrana osobních údajů

Osobní údaje (adresa bydliště, telefon, email), které uvádíte ve své objednávce jsou zpracovávány za účelem vyřízení objednávky a ke komunikaci se zákazníkem. Provozovatel se zavazuje neposkytnout získané osobní údaje třetím osobám, vyjma dopravcům zboží, a to pouze v rozsahu nutném pro doručení zásilky.

Svou registrací v internetovém obchodu www.chodicizvirata.cz, www.chodicizviratka.cz souhlasíte se shromažďováním a používáním údajů o Vás a Vašich nákupech po dobu neurčitou. Na Vaši písemnou žádost mohou být po vyřízení objednávky vymazány.

Below you find the most important information on our offers, contract conclusion, shipping, etc. Please don't place an order if you don't agree with our terms and conditions.

Preamble

The company STAND-BY Europe,s.r.o. (hereinafter referred to as "STAND BY") offers their customers various products though the online-shop - www.chodicizvirata.cz. For this purpose some issues in these terms shall apply in addition to the terms that are statutory. "STAND BY" tries to describe and control the offered products in shop as good as possible. If against one`s expectations errors or obscurities occur please send us a short mail so that we can solve the problem as quick as possible.

1. Offer and contract conclusion

All offers are subject to change without notice. All technical change or changes in shape, colour or weight are subject to alterations if just and reasonable for the customer. All technical details, drawings, pictures, weights, colours, descriptions are customary approximations for this line of business. "STAND BY" doesn't take the risk of procurement. This purchasing contract is only valid under reserve and depends on correct and punctual supply to ourselves unless otherwise agreed to in writing.


The liability of "STAND BY" in regards to malicious intent, gross negligence or negligent breach of contractually significant obligations stays unaffected.


Conclusion of contract: the orders placed at "STAND BY" via internet www.chodicizvirata.cz, email info@chodicizvirata.cz, are offers, that the customer is bound to for seven (7) calender days. With the purchase order placed the customer declares bindingly that he wants to buy the contents of the shopping cart. Right after the order placement, the customer gets an email confirmation. The purchase contract is valid after reception of your online-order and when you have received an order confirmation or the products have been shipped within seven (7) days. With our expressly or implied acceptance the purchase contract is concluded, if our acceptance is valid.

2. Payment

Our shipments can be paid direct debit or prepayment. ALL INTERNATIONAL SHIPMENTS OUTSIDE CZECH REPUBLIC MUST BE VERIFIED BY THE EMAIL.

All bank charges must be paid by the buyer.

The buyer will also receive the bank details for the prepayment in the email confirmation right after placing the order.

The sales prices include the legal Czech VAT of 21% You will find the shipping cost in the confirmation email in advance. Shipping costs outside the EC (European Community) are part of a separate agreement and price.

When paying by prepayment, the customer is bound to wire the open amount including shipping with eight (8) calender days without deductions. Special agreements are possible and need the written approvall by "STAND BY". If the money is not received within eight (8) calender days and after a further payment request, the customer is in default. Valid in any case is the payment receipt on the"STAND BY" account.

3. Delivery

You chose prepayment as payment method, the order will be shipped after payment receipt to the address of the buyer. "STAND BY" ships on five days of the week. If the buyer announced his email address at the time of order placement, a shipping notification will be sent out when the parcel is shipped.

4. Disclaimer

You can cancel your order within 3 days without reasons. The cancellation must be in writing via e-mail, fax, letter or by returning the product(s) within the two week period. This period start after receipt of this note in writing, but no earlier than after receipt of the goods at the buyer and also not before our duties to inform the buyer.

In case of a legally effective disclaimer, all mutually received goods and services have to be returned and accured interest has to be paid back. If you can only return the goods received partially or defective, you have to pay value replacement. This is not valid, if the goods were only inspected and opened as it would be when trying out the product while visiting our shop. Please return the goods wrapped and without damaging the product box. You have to pay the shipping for return the product if the product is the product you ordered or if the product's value is less or equal EUR 150,00 or in case of a higher product value if you have not wired the necessary balance that was agreed to. In all other cases you don't need to pay for shipping. Products that can't be shipped becaue of weight or size will be picked up. Possible payments need to be returned within 30 days. The disclaimer period starts for you by sending us the goods back or a disclaimer and for us when we receive the goods or the written disclaimer.

There is no right of cancellation for the following products:

  • Spare parts especially made or ordered for you or that can`t be returned becaue of shape.

  • Please send back all boxes that are part of the product. Banking charges for wire transfers to a foreign account will be paid by the buyer.


Reasonable partial deliveries are acceptable. During the order process the buyer can choose, whether she or he would like the order to ship complete or partial. Every partial shipment counts as a single delivery and service of work. When ordering products, that are not published at the time of order receipt, we will charge the delivery costs for the subsequent delivery as low as possible.

Complaints for incomplete or defective delivery have to be made immediately, seven days after reception of the products at the latest. Damaged boxes/ shipments must be claimed by the buyer right at reception from the freight carrier. Claims for damaged boxes must be made right to the freight carrier.

5. Guarantee

The warranty for all products is 24 months starting the day of dispatch. Should a product fail within warranty, the seller has the right to elimination of the faults. In case that elimination fails, the seller can replace the faulty product with an equivalent new product. If that is impossible, the purchase price will be recompensated.

Further claims for damages are excluded. Apparent defects need to be reported to the seller in writing within two weeks after receipt of the goods. The seller is not liable for defects, that are in direct connection to a false or inroad use of the product, for example if a products was taken apart in a wrong way not authorized by the seller or if the operating instructions where not followed. Normal wear is not covered by warranty.

The pure presentation of the product on the website can be regarded as pure technical description and at no time as warranty on the shape and nature of the product.

6. Liability

"STAND BY" is liable in cases of intent and gross negligence and in cases of positive breach of obligation. Moreover, "STAND BY" is liable in the event of injury to life, limb and health. In case of culpable breach of contractual cardinal obligations or fraud. "STAND BY" is liable within the framework of legislation. Only in cases of a breach of cardinal obligations, the liability of employees of "STAND BY" is limited to typical, foreseeable damage. Consequential damages are excluded to that extent. In cases of delayed performance, the customer is entitled either to compensation in damages or to rescind the contract.


In cases of loss of data "STAND BY" is only liable, if the Customer has saved the data stock on a regular basis at least once a day and is able to prove this. Otherwise, liability is excluded, except for cases of intent or gross negligence.


The extent of liability of "STAND BY" under the Law governing Product Liability remains unaffected.


The above mentioned provisions represent the entire extent of liability of "STAND BY", its management and its employees.

7. Reservation of propriertary rights

In case the order was not shipped prepayed, the right of property for the goods doesn't transfer to the customer until full payment is received by "STAND BY". Before that transfer, the customer can`t sell or give away the product.

8. Final Clause

Czech rep. Law applies. The application of the UN-Agreement on Contracts on the International Purchase of Goods is excluded.

The provisions of clause 6. leave binding provisions of the state's right, in which the Customer is resident, unaffected, if and as far as the Customer has entered into a purchase contract, which cannot be assigned to the Customer's professional or commercial activity (consumer contract) and if the Customer has taken all legal action in the state of his usual residence which is necessary for the conclusion of a purchase contract.

Place of execution is the Prague, Czech Republic. For all current and future claims from the business relationship fully qualified traders is Prague, Czech Republic. The local place of jurisdiction of the buyer's residence is responsible for all other customers.

Personal data will only be stored, if you gives use the approval by placing an order, by opening an account or if you register for the newsletter. We will only use the provided data from you to process your order. After the completion of the ordering process and complete payment your data will be locked and erased after expiration of the tax- and economical laws, if you haven`t agreed to further usage of your data. If you sign for the newsletter we will store and use your email address for advertising until you sign off from the newsletter.

Transfer of your personal data

Your data will be given to the shipper, if needed to ship the goods to you. 

Your personal protect worthy concerns will be accounted for according to the current law. A further circulation of your data to other parties will not occur.

We protect our website and the furhter systems with a technical and organised actions against loss, demolition, access, modification or distribution of your data by unauthorized persons. You got a right to get a free information on your stored personal information and if applicable the right to edit, block or delete the data.

Disclaimer

If you have approved one of the upcoming agreements during the ordering process, we want to advise you that you can cancel this agreement at any time for the future.

Opening an account: I want to open an account. This way I can log on this website with user name and password with the next purchase, without putting in all my personal data again. I agree while opening a customer account that my data like name, address, email, telephone number and the user figures (password) will stored in a customer file. This agreement can revoked at any time for the future by sending a letter, a fax or an email (to info@chodicizvirata.cz).

Permission for email advertising: I want to be regulary informed about news and interesting offers by email. My email address will not be given out to other companies. This agreement to use my email adress for advertising can be revoked at any time for the future by clicking on "Unsubscribe" at the end of a newsletter or by opening the site "Newsletter subscription/unsubscription".
